September 26 Court’s Decision on Radio Hereti

On September 26 Collegium of the Administrative Cases at the Tbilisi City Court will announce the final decision about in suit of the Radio Hereti vs. the Georgian National Commission Communications.

“Hereti” has appealed against the commission after it imposed a fine of 5 000 GEL on the radio company as of December 6, 2007.

The commission claims that Hereti illegally used a radio frequency. The lawyers of the Hereti think that the protocol was outdated and must be canceled because the commission would be provide information about the broadcasting future of the radio station.

“Although Hereti paid the license tax on time and followed all requirements of the competition, the commission issued the license to the radio station seven months later, and only after some incidents happened at the radio station. If the society had not reacted and public defender had not done his utmost, we would not be working now,” said Ramaz Samkiharadze, director of the Radio Hereti.

On December 11 2007 Communication Commission initially granted the license to the broadcasting company “Hereti and then imposed it with a stiff fine of 5 000 GEL.

The court discussion of the case started in February 2008 and has lasted during the last 8 months.
