Appeal Court of Rejects Radio Hereti Law Suit

November 27, 2008

Tbilisi Court of Appeals did not satisfy the suit of broadcasting company Hereti tofr invalidating an administrative decision of the Georgian National Communications Commission (GNCC).

The court filed the verdict on Radio Hereti’s suit today. Ramaz Samkharadze, director of Radio Hereti considers that the court made a political decision.

“The Tbilisi Court of Appeals proved once again that the court system in Georgia is politically biased. The court supported the illegally administrative act of GNCC that imposed a fine on our radio station. Radio Hereti possesses all necessary documentation which proves that the radio station was broadcasting in accordance with the law,” stated Ramaz Samkharadze.

Marekh Mgaloblishvili, the attorney of the radio station says that she will appeal the Tbilisi Court of Appeals’ decision in the Supreme Court.

GNCC issued a broadcasting license on Radio Hereti on December 11, 2007 up to 2017 but fined the radio station 5,000 GEL on the very same day. The Commission considered that the radio station violated the Georgian Broadcasting Law. The Hereti administration considers that the GNCC decision to fine the station was politically motivated.
