Sum of Bail Was Returned from Discharged Accused

Tbilisi City Court found Tea Chkhartishvili not guilty; she was accused for having purchased the subject that was stolen premeditatedly by another person.  More precisely, on January 6, 2006 individual entrepreneur Tea Chkhartishvili purchased mobile phone “Sony Ericson”, (price 180 GEL, 90 Euro) from Shalva Tevdoradze  at her own pawnshop; Tevdoradze had grabbed the phone from Giorgi Sichinava from 5 to 10 January 2006.

As a result of the analysis and evaluations of evidence in case materials the court concluded that the activity of the accused shall not be charged under the Georgian Criminal Code. She was not guilty for the crime because T. Chkhartishvili could not have information that the mobile phone was stolen. This conclusion worked as a basis for discharging the accused from the accusation.

The court did not consider the petition of the prosecutor’s office and found Tea Chkhartishvili not guilty. The court also canceled the bail imposed on Tea Chkhartishvili and returned the sum to the accused.

Tea Chkhartishvili has right to demand compensation for financial and moral damage.
