The Young Lawyers Association [the “GYLA”] demands that an appeal be allowed against administrative arrest. Tamar Khidasheli, the head of the GYLA made a statement about it at the meeting of the Parliament Committee for Human Rights.
According to her, the demand may result in decisions against Georgia by the European Court because there have been similar decisions by the Court.
“One example is when European Court ordered quite a big sanction against Armenia, because the Armenian Statute does not provide for such an appeal,” said Khidasheli.
According to her, the European Court considers that if an arrest term lasts more than 7 days, there must be opportunity to appeal against it immediately.
“According to the Georgian Administrative Statute, the arrest term lasts from 30 to 90 days, so the failure to fulfil the already existed recommendation of a right to appeal is getting more and more serious,” noted the head of GYLA.
Lasha Tordia, co-editor of the project for making amendments in the Administrative Code, expressed his readiness to start discussion and argument about the issue.
