Court Explained Its Refusal on Satisfying the Suit of TV 25

The court explained the reason of its refusal to satisfy the suit of TV-25. According to the Supreme Court of Georgia Batumi City Court did not satisfy the suit of the TV-25 Ltd and did not change the Tax resolution which imposes the company to pay 277 547 GEL to the state budget and other funds.

The suitor considered the decision of the Kutaisi Appeal Court of April 22, 2008 to be the legal ground to annulling the tax resolution of July 28, 2009. The Appeal Court annulled the debt of 438 138 GEL imposed on the TV Company. Kutaisi Appeal Court ordered the Batumi Tax Department to study the factual circumstances of the case and adopt new administrative act. Batumi Regional Center released the tax request based on the administrative act adopted in 2004. As for the requirements of the suit Batumi City Court concluded that the tax examination was scheduled and it did not require permission from the judge. Besides that, the Law of Georgia on Amnesty and Non-declared Tax Obligations and Property Legalization does not work for the sums accumulated on the suitor. Consequently, the court concluded the suit of the TV-25 was groundless and did not satisfy it.
