Parents of the Accused Seek for Justice

Parents of the accused Sergo Mikadze appealed to the Human Rights Center for help. They spoke about the crime which happened on August 11, 2005 in Kobuleti. According to the investigation, Sergo Mikadze, together with “unidentified people” attacked Murman Jincharadze and seized mobile phone, wallet and important personal documents from him under threat of gun.

Kobuleti district court judged Sergo Mikadze in his absence and found him guilty under Article 179, Paragraph II-“a” and Article 363, Paragraph II of the Criminal Code of Georgia. Based on the judgment of the Kobuleti district court, on October 8, 2008 Mikadze was sent to prison for 7 years and 6 months. Besides that, the court imposed bail of 5 000 GEL on him.

Sergo Mikadze is wanted now.

Lawyer for the Human Rights Center Eka Kobesashvili said that the investigation was carried out through violation of the law. “Most part of procedural documents does not comply with the law. These documents shall be removed from case materials. No evidence and document are provided in the case materials except mobile phone which was lost by the victimized person. Besides that, the crime is qualified incorrectly. More precisely, Mikadze was charged under Article 179, Paragraph II-“a” which envisages robbery after getting into the dwelling of other person. The case materials do not demonstrate such crime.”

It must be noted that the second accused, who was mentioned in the criminal case, was discharged because of lack of evidence.
