Prosecutor Provided Unsealed Evidence at the Trial on Vakhtang Maisaia

The Prosecutor provided unsealed evidence at the trial on military expert Vakhtang Maisaia. Attorney of Maisaia, Natia Korkotadze stated that the computer withdrawn from the detainee’s house was immediately sealed. However, at the court it was provided unsealed.

“The computer, which was withdrawn from the house of my client by the officers of the counter-intelligence department, was immediately sealed and it was confirmed by the protocol signed by his wife and the neighbor. However, at the trial on January 22, the court provided it unsealed. Consequently, the defense side requested to decline it as evidence.  However, one hour after the trial incredible fact happened: we were called from the court and requested to return back to the court. Having arrived at the place, we found out that judge Zviad Esebua decided to seal the proofs on the place in order to protect them. Defense side of Maisaia categorically refused to seal the proofs; as for the state attorney of Irakli Bakhutashvili, former military attaché of Georgia in NATO, signed the protocol,” reported Korkotadze.

According to the attorney, on January 25, the defense side will have three motions. “1. We will request to declare the proof inadmissible; 2. We will request to replace Judge Zviad Esebua because he acts in accordance to the directives; 3. We will request to protect the claimings,” said Korkotadze.

Military expert Vakhtang Maisaia was arrested for espionage on May 5, 2009.
