Juvenile Suspected of an Attempt of Premeditated Murder Was Released from Prison

Judge Mamuka Tsiklauri at Telvi district court satisfied the request of the lawyer and changed imprisonment into a bail for the juvenile suspected in an attempt of the premeditated murder. 15-year-old B. E. spent five months in prison.

Gurjaani district prosecutor’s office accused the pupil of the 10th grade of the public school in the attempt of the premeditated murder of his neighbor. The boy was arrested on November 25, 2009. According to the bill of particulars on November 15, 2009 N.A. crashed the dog of B.E. by car and killed it. B.E. decided to punish the neighbor by killing him. At the same night he took his grandfather’s gun and shot N.A. who was standing on the balcony of his house. He was wounded but doctors saved his life.

After the detention of the juvenile, his parents found the letter in their yard where the anonymous person wrote that he saw who in fact shot N.A and named him. The parents took the letter to the police station and made additional testimonies to the investigation. They agreed with the information written in the letter and clarified why the person mentioned in the letter had shot N.A. On March 2, the house of the detainee’s parents was burnt down.

The juvenile did not plead guilty. The teachers of the boy evaluated him as a good pupil and categorically excluded the possibility that he could commit a crime.

The representatives of the Human Rights Center monitored the court process. Before the monitoring, the representatives of the human rights organization studied the case materials. The Kakheti region coordinator of the Human Rights Center Gela Mtivlishvili reported that there is no evidence which could prove that the juvenile committed the crime.
