Unprecedented Illegality – Victims Are Accused

On September 16, at 1:00 pm the Human Rights Center will hold a press-conference about the case of young boys who were arrested for hooliganism. They are: Zaza Shavliashvili, Vasil Gigiuashvili, Nika Beruashvili, Roland Nikolozashvili and Saba Mghvdeladze.

On October 13, 2009 two groups of young fellows had a quarrel which resulted into wounding of 6 boys. The investigation concluded that the quarrel was initiated by the second group who stabbed Zaza Shavliashvili, Vasil Giguashvili, Badri Mikatadze, Nika Beruashvili, Roland Nikolozashvili and Saba Mghvdeladze as a result of the incident. Initially, only Levan Abashidze was detained for the accident; the court has already convicted him to imprisonment.

In October of 2009, the investigation found Zaza Shavliashvili, Vasil Giguashvili, Nika Beruashvili, Badri Mikatadze, Roland Nikolozashvili and Saba Mghvdeladze to be victims. Three months later, on January 5, 2010 the victims were unexpectedly detained and they were also charged for hooliganism under the Criminal Code of Georgia. The prosecutor’s office launched separate case against them.

Although the health conditions of the “accused victims” are quite grave because of the wounds, the court does not satisfy the petition of the attorney to release them under bail. After wounding, Saba Mghvdeladze suffers from the tuberculosis of the intestines; Zaza Shavliashvili has C-Hepatitis because of the wound in the liver. The health conditions of other detainees are also difficult. The families are ready to sign plea-agreement because of the bad health conditions of their children. However, the prosecutor’s office does not agree with them.

The lawyers of the Human Rights Center state that the young boys are groundlessly arrested; it can be easily proved by the fact that there are no victims in the criminal cases which are launched against them. Furthermore, they are victims in the same case. It is unprecedented illegality.

The attorneys and the family members will speak about the case details at the press-conference at 1:00 pm in the office of the Human Rights Center. On the same day, the next trial on the case is scheduled at the City Court at 3:00 pm (Davit Aghmashenebeli Lane 12th kilometer, # 6, Judge Badri Kochlamazashvili)
