Appellate Court Started Hearing Cases of Female Convicts of Prison Mutiny

On October 5th, Tbilisi Appellate Court started hearing the cases of female convicts of prison mutiny. As Tamar Tsereteli, a lawyer of one of the convicts Nana Arabidze stated, the Appellate Court already started hearing their complaints. All 25 convicts are appealing against the verdict of guilty passed by Tbilisi City court and requesting its abolition. The case examined by the board of judges is headed by Giorgi Chemia. The Court sessions will take place in Tbilisi City Court.

At first, court was examining case of 38 women, but then the office of prosecutor made a procedural agreement with 13 convicts and their cases were separated from others.
25 prisoners were sentenced for disobedience to the lawful order of the penitentiary department officials, disorganization of the department’s activity and attack on the administration, also, the unlawful destruction of documents with private motives and damaging other’s belongings.

They were sentenced from 3 years and 6 months to 13 years in prison, since all the convicts have been sentenced for different categories of crimes in the past, and the final sentence was calculated considering the aggregate of verdicts – under 25 year imprisonment.

The case regards the mutiny occurred in #5 Penitentiary Department for Women and Under Aged on April 18th, 2009.

According to court, the criminal conduct of convicts was reflected in the following: on April 18th, 2009, the administration of #5 Penitentiary Department for Women and Under Aged published the list of pardoned convicts according to the President’s decree of April 18, 2009.

Some convicts who were not included in the list of pardoned, got armed with sticks and other items and called for support of other convicts. They didn’t obey the lawful order of the administration, destroyed the documentation and damaged the belongings of administration by starting the fire and other means. Ultimately, the crime was stopped by the unit of special objective.

Next court session will be held on October 18th.
