Venice Commission Calls upon the Government of Georgia to Wait for Their Final Recommendations

In its recent report the Venice Commission calls upon the government of Georgia to wait for their final recommendations and thoroughly consider them before the amendments to the constitution of Georgia are enacted.

The Commission appreciates several amendments to the Constitution in its report which was published on October 8 but it also underscores that the restricted duration of the procedures for declaring the non-confidence to the authority is not enough; the gaps still remain in the functions of foreign policy of the president and the government and the role of the parliament shall be increased. The Commission has some notes about the duration of the work-out of the judges too.

The Venice Commission also discusses the accusations of the opposition against the government and which claims that the amendments to the Constitution do not aim to improve the current system but to assist the president Saakashvili to stay in the government for longer time.

The Commission stated that it is beyond its competence to speculate about the topic and declination of the draft-amendments only based on these accusations is not correct.

The Commission once more declared that the draft-amendments offer “several important improvements and serious steps towards the improvement” in comparison to the system which was created in 2004.

The Venice Commission published its initial recommendations in July of 2010; afterwards several changes were made in the draft-amendments to the Constitution. Consequently, this is the renewed variant of the Commission’s opinions base of which were those amendments which were introduced to the draft constitution by the parliament of Georgia on October 1 on the second discussion of the draft-project.

The parliament intends to discuss and enact the draft amendments this week. The project is already agreed on principal level and only editorial changes will be introduced to it.
