The Bodies of Regulation Intervening in the Defense of Consumers’ Rights

December 23, 2010

The bodies of regulation will intervene in the defense of consumers’ interests in their sphere.

According to the existing legislation, Public Defender of Consumers’ Interests  operating at the Independent National Body for Regulation will be selected by the public defender at the open contest. The Commission will merely be obligated to pay the salary.

Public defender creates the commission for selecting the public defender of consumers’ interests with no less than 15 members. The state and NGO representatives will be included in the commission.

According to the new bill initiated in the Parliament, the commission will be comprised of no less than 12 members and the representatives of the bodies of regulation will be included in it.
The Commission is determining the conditions of contest by majority vote. According to new bill, these conditions must be agreed on with the relevant body of regulation.

Besides, there are changes in the conditions for dismissing the public defender of consumers’ rights. Particularly, until now one of the reasons for dismissal was the guilty verdict ruled by Court that envisaged imprisonment as a penalty. But according to the initiated bill, the public defender will be ceased his/her authority in case of any guilty verdict.

The authors and initiators of the bill are Pavle Kublashvili, Giorgi Meladze, Zviad Kukava and Chiora Taktakishvili.
