Lawyer of the Human Rights Center and Prisoner Locked in One Room

“Penitentiary institution breaches the rights of the prisoners’ visitors,” the lawyer of the Human Rights Center Nino Andriashvili said. According to the lawyer, her right was breached in the prison # 17 on May 20.

Nino Andriashvili said the prison personnel locked her in the room when she was meeting prisoner as his lawyer.

“When I asked the prison guard why they were locking us in the room, he said it was internal decision of the prison administration and aimed to take all measures to prevent the prisoners from moving around the custody freely.”

The lawyer clarified that the prisoner, whom she was meeting at the moment, was a disabled person and moved only with the support of the wheelchair. In addition, the prison guard is authorized to protect the security of the custody and should not take any degrading measures to guarantee safety in the detention setting.

Nino Andriashvili petitioned to the Ministry of Corrections and Legal Aid of Georgia to respond to the fact.

The representative of the Human Rights Center added that locking of the door breaches the rights of the lawyer. The “new” method of the prisoners’ control demonstrates inefficient activities of the prison personnel who cannot prevent incidents in the custody with more civilized methods. “The prison administration exceeds its competence and restricts the freedom of the lawyer too.”

The International Pact on Civil and Political Rights clarifies that everybody has right to freedom and personal inviolability. Nobody shall be detained or imprisoned; Article 18, Part II of the Constitution of Georgia states that deprivation of liberty or other restriction of personal liberty without a court decision shall be impermissible.
