Socially Needy Family of Poghosianis Loses Case against Batumi Mayor in the Appellate Court

Regarding the dispute between the family of Mayor of Batumi and socially needy family of Poghosianis Kutaisi Appellate Court made decision for the benefit of Batumi mayor.

According to the decision of the court of first instance, Poghosianis will have to pay 13 300 US dollars to the mayor and his relatives. The Appellate Court decreased the amount of imposed money only by 2 000 US dollars.

Irakli Shavadze, Eduard Poghosiani’s lawyer: “Kutaisi Appellate Court partially satisfied our complaint. Poghosianis were deducted 2 000 US dollars. Before making the decision, the Appellate Court offered the parties to make plea bargain agreement that envisaged the deduction of disputed property – 59 square meters which has been alienated. This would be logical and my client did not have a pretension about it. However, another party did not give its consent. We are going to submit cassation complaint to against this decision.”

Despite the proposal to plea bargain agreement, the Court decision is beneficial for Batumi mayor and his relatives. Kutaisi Appellate Court made decision on this case on June 30th. After making the written decision, socially needy Poghosianis are going to continue their dispute. The property under their ownership has been sequestrated. The former property of Poghosianis – now an alienated property of 50 square meters is also sequestrated.
