Law Enforcement to be Authorized to Copy Data from Communication Channel

December 23, 2011

Law enforcement will be authorized to copy data from the communication channel. The amendment appeared in the draft law on Operative Investigation Activity.

According to the decision of Parliament, in order to fulfill the goals of operative-investigation activity, the relevant bodies will be authorized to copy data from the communication channels.

In this case, the court authorization is needed to transfer the information. However, in the force majeure situation, it is possible to do it without the court permission.

Following state agencies have right to conduct operative investigation activities: Ministry of Internal Affairs, Ministry of Justice, Ministry of Corrections and Legal Assistance, Ministry of Defense and Ministry of Finance. Also, Intelligence Service and Special Service for State Protection can take such measures.
