Tamar Chugoshvili: “Control Chamber Interprets Law Differently”

According to the head of Georgian Young Lawyers Association (GYLA) Tamar Chugoshvili if the Parliament does not change new regulations of Political Unions of Citizens of Georgia it might bring us to severe results.

Chugoshvili stated the following at the meeting between the leadership of Control Chamber and representatives of NGO sector of Georgia.

“The interpretations of Control Chamber of Georgia are not complying with the law. In reality the law establishes different provisions. For instance, the law clearly establishes that the bodies which are considered to be linked to political parties will not be able to receive any kind of income other than donations from the physical persons. However, Control Chamber gives absolutely different interpretations,” – Chugoshvili stated.

According to her, the law is completely vague and all NGOs agree on that its new provisions are absurd.

“It is clear that the law is a completely vague and its provisions are absurd, but the explanations made by the Control Chamber go way beyond its formulation. I think that this formulation gives Control Chamber a possibility to make very subjective and ungrounded decisions in relations with concrete organizations including NGO, business and media organizations as well as against the interests of the physical persons. Once again I am assured that if the Parliament does not change these concrete articles, it might bring us to severe results,” – Chugoshvili noted.

Besides, the head of GYLA does not exclude that the Financial Monitoring Service of Control Chamber may request the financial accounts of her organization. According her, if the New Generation – New Initiative was asked to present information on its activity, no organization can have any guarantee.

“The argumentation presented for requesting financial account of New Generation New Initiative does not comply with the law. Nevertheless, this organization was still identified as having some political ties. Nothing can be excluded now. If the law does not change any organization including any media outlet can be requested to present the report on its financial activity. We constantly locate information on the financial activities of GYLA on our website but this new regulation cannot be applied towards GYLA. This is nonsense and the Control Chamber must substantiate it,” – the head of GYLA stated.

According to Tamar Chugoshvili, Control Chamber gravely intrudes in the work of NGOS and NGO sector will apply all means to change new regulations.

“In order to change completely absurd regulations of law, in the first place we address the Constitutional Court of Georgia also the Parliament with a legislative proposal and we carry out active civil campaign,” – Chugoshvili noted with the journalists.

On February 10th the head of Control Chamber of Georgia Levan Bezhashvili and head of Monitoring Service Natia Mogeladze met with the representatives of NGO sector where Levan Bezhashvili introduced his explanations of the law to the media.interpressnews
