Zaza Khatiashvili-Fired Prosecutors Request To Become Lawyers, That Is Bad For the “Bar Association”

“Prosecutors, who were fired from work, request to become lawyers that is bad for the “Bar Association”, chairman of the “Lawyer Association” Zaza Khatiashvili told Interpressnews.

According to him, the Association is not authorized to refuse former prosecutors to become lawyers due to their past activities and faith, though 10 of them were already declined on different grounds.

According to Khatiashvili, Giorgi Chiviashvili, Gizo Ugulava, Romeo Sajaia, Aleksandre Mgeladze, Levan Khutsishvili, Shota Gengashvili, Giorgi Oniani and Mileri Kharebava are former prosecutors, who were declined by the Association in accordance to the law.

“Approximately ten applicants were declined because 7 years had passed since their last tests. According to the Article 21 Part III of the Law on Lawyers, if 7 years have passed since last tests person cannot become the Association member. We suggest them to take an exam and if they pass, they will become our members. 90% of sacked prosecutors come to the Bar Association and wants to join it that is too bad for the Association. When a prosecutor comes to the Bar Association, he must have lawyer’s mentality. During the previous government, if a person was fired or did not want to continue working somewhere, she/he used to apply to us for the membership. It is serious problem for the Association and relevant amendments shall be introduced to the Law, that will regulate the process,” said Zaza Khatiashvili. According to his explanation, Association is not authorized to refuse a prosecutor to become a lawyer because of his/her past activities.
