Prosecutor’s Office Withdrew Zurab Giguashvili’s Case from the Court

Court proceedings against Zurab Giguashvili, uncle of the former defense minister of Georgia Irakli Okruashvili, were dropped. At the trial on April 16, prosecutor declined its accusation and solicited to withdraw Giguashvili’s case from the court. The judge upheld the solicitation.

Court proceeding on the case against Zurab Giguashvili finished. At the today’s trail the prosecutor withdrew Giguashvili’s case from the court. They made the decision after having questioned all witnesses who claimed their statements to the investigation were not true and Zurab Giguashvili was not guilty.

Human Rights Center took up Zurab Giguashvili’s case at the moment he was charged for the criminal case. Head of Center’s Legal Aid Center Nino Andriashvili protected his rights at the trials.

“Substantial discussion of Giguashvili’s case was postponed several times lately because the prosecutor’s office intended to raise solicitation on withdrawing the case from the court. The prosecutor made the relevant statement at the trial after their witnesses stated at the court hearing that they had made initial testimonies under oppression and intimidation.

Afterwards, the prosecutor’s office requested to postpone the process in order to agree the issues with senior prosecutor. Several hearings were postponed on that ground. Finally, today on April 16 prosecutor raised solicitation and declined the accusation; they requested to uphold the solicitation saying there were no signs of crime in Giguashvili’s case. The judge upheld the solicitation,” Nino Andriashvili said.

Pretrial session on Giguashvili’s case was held in October of 2011 after what the process was suspended during one year. The proceedings renewed in November 2012. Meanwhile Zurab Giguashvili was sought but based on the Amnesty Law adopted in 2013 the quest was canceled. As a result he returned to Georgia.

Criminal case was launched against him under Article 223 Part II of the Criminal Code of Georgia – participation in the creation of illicit armed formation.
