“Every Day Spent in Prison by the Victims of Torture and Arbitrary Judgments Is Equal to Torture”

On July 16, Human Rights Center presented information about the convicted Tamaz Rasoyan, torture victim, to the representatives of media; the presentation was held in the conference hall of the Human Rights House Tbilisi.

Human Rights Center addressed to the Joint Permanent Commission of the Ministries of Penitentiary and Healthcare to early release convicted Tamaz Rasoyan. He has been in custody since 2004 and has almost served his term for the premeditated murder but in 2009 a new charge was imposed on him in the penitentiary establishment – membership of criminal world – 11 years were added to his term. Tamaz Rasoyan does not plead guilty in it.

Executive director of Human Rights Center Aleko Tskitishvili clarified that Tamaz Rasoyan had not lived according to criminal traditions and before imprisonment he worked at the car-washing service. Prison administration imposed the new charge on him after they compelled other inmates to make testimonies against Rasoyan. Currently, those people are ready to make real testimonies to the prosecutor’s office.

Physical and psychological torture of Rasoyan in the penitentiary establishment deteriorated his health conditions. His aunt Zina Shabeshov spoke about it at the press-conference.

Lawyer at Human Rights Center Nestan Londaridze said the convicted person suffers from several diseases on the list of diseases that can become ground of the prisoner’s early release under Article 37 Part II of the Imprisonment Code; on that ground he must be released from prison.

Aleko Tskitishvili said, the state is authorized to ensure legal and psychological rehabilitation of torture victims, who served their terms in penitentiary establishments. At the same time, the prosecutor’s office shall study and respond to the appeals of these prisoners; otherwise, every day they spend in prisons it is equal to torture.

Relative of another prisoner Islam Derboev also attended the press-conference. Derboev has same problems and he applied to Human Rights Center for help short time ago. The Center took up his case too.
