General Inspections of Ministry of Justice and Chief Prosecutor’s Office Divided

General inspections of the Ministry of Justice and Chief Prosecutor’s Office were divided. Interpresnews was informed from the Ministry of Justice that based on the Minister’s decree, which was published on the Legislative Herald on August 14, the functions of the General Inspection of the Ministry were reformulated and a new GI was created within the Chief Prosecutor’s Office. 

According to the Ministry, their GI will subordinate to the Minister and the GI of the Prosecutor’s Office will subordinate to the Chief Prosecutor.

“Hence, GI of the Ministry inspects how effectively the employees of the Ministry and public law legal entities within the ministry (House of Justice, CRA, State Service Development Agency, National Enforcement Bureau, National Archive, Notary Chamber, Legislative Herald, Center for Crime Prevention and Innovative Programs, Smart Logic, Data Exchange Agency, Justice Training Center) follow the laws – in order to avoid possible violation of legal rights and interests of citizens,” the Ministry stated.

According to the Ministry, GI ensures exposing the facts of interest incompliance, control of implementation of professional ethic rules, inspects compliance of the activities of private executers and notaries with the law, and inspects activities of financial divisions at the Ministry and public law legal entities (Control of budgetary and non-budgetary funds).

Additionally, the Ministry’s GI investigates professional violations by the employees of the Ministry of Justice (except the employees of the prosecutor’s office) (misuse or exceed of professional power, coerce of clarification, testimony and conclusion, illicit participation in entrepreneur activities, accepting or giving a bribe, bargaining with influence, professional fake, professional negligence, accepting illegal gifts).

As for the recently established GI in the Chief Prosecutor’s Office, it has the same authorities with regard to the employees of the prosecutor’s office as the General Inspection at the Ministry. Hence, GI at the Prosecutor’s Office will be authorized to study complaints of citizens about the prosecutor’s office personnel and to investigate any offence allegedly committed by the employee of the prosecutor’s office.
