GNCC vs Super TV dispute completes with agreement

Dispute between the Georgian National Communications Commission (GNCC) and cable company Super TV completed with agreement – GNCC decreased the penalty and Super TV will have to pay only GEL 3 thousand. 

The case concerned the GNCC 21 December 2011 decision.  With the aforementioned decision the GNCC fined Super TV with GEL 43 thousand 31 for illegal transit of several channels.  Volume of penalty was defined at one percent of one-year revenue of the Company.  Super TV complained in Court against the decision.  As decided by the Court of Appeals the penalty was decreased by GEL 19 thousand, although the case went to the Supreme Court which proposed the parties to come to an agreement which was signed 27 November 2013. 

According to the Agreement Act, Super TV recognized the fact of violating the law and the GNCC is ready to change the volume of penalty and set it to GEL 3 thousand.  In addition Super TV takes obligation to annul the cassation complaint submitted to the Administrative Chamber of the Supreme Court and to pay for Court expenses.
 
Super TV has already paid part of amount to the budget so the GNCC will address the coinciding State body to reimburse the amount. 

According to Super TV lawyer Archil Tabagari, Supreme Court called on the parties several times to come to an agreement and to decrease the volume of penalty as the Supreme Court did not want to interfere with the decision of the GNCC and to change its regular practice. 

The parties will submit the agreement act to Supreme Court 28 November.
