Human Rights Center addresses to the Kakheti regional department of MIA to take effective measures with regard to the fact of thievery and damage of personal items of Elza Shekriladze in Gurjaani district. Human Rights Center is concerned about indifferent and negligent approach of the Gurjaani district department of MIA to the aforementioned facts.
T.K. had illegally occupied Elza Shekriladze’s house during years. People broke into the house and did not want to leave it regardless the relevant court judgment. With legal assistance of Human Rights Center, in September 2014 Elza Shekriladze gained her house back, which was finally freed from voluntary inhabitants in accordance to the law.
Having entered her house, Elza Shekriladze found walls damaged and removed, some of her personal belongings were stolen. Human Rights Center and Elza Shekriladze petitioned to the Sagarejo district department of MIA with the request to launch investigation into the fact. The petitions were enclosed with the documents, which proved that things were stolen from the house and walls were damaged.
In reply to the petitions, Sagarejo district department sent two completely different letters to applicants. The department responded to Human Rights Center that they studied Shekriladze’s petition but could not detect signs of criminal offence in the fact. As for their response to Shekriladze, the department wrote that court judgment was already passed into the criminal case and it was impossible to charge one person twice for one crime.
Based on the letters we assume the Gurjaani district department of MIA did not study Shekriladze’s petitions because recent facts of thievery and damage of property are completely different from those for what T.K was judged in the past.
Human Rights Center appeals to the Kakheti regional department of MIA to start investigation into the case and find out real reasons of Sagarejo district department’s indifferent and negligent approach to the violation of property rights and legal interests of the citizen.
