Emzar Kvitsiani to Appeal against Saakashvili

“Justice won; son of the Kodori Gorge is free,” on January 28, family members, relatives, IDPs from Kodori Gorge and strange people greeted Emzar Kvitsiani with these words when he left Kutaisi Appeal Court. The Court freed the former Zemo Svaneti regional governor based on the plea-agreement after 11-month imprisonment.

Lawyer Aleksandre Kobaidze clarified that Prosecutor’s Office offered plea-agreement to Kvitsiani, who was blamed for the creation-leadership of illegal armed formation (Article 223 Part I of the Criminal Code of Georgia) and for plotting against the state (Article 315 Part III of the CCG).

The parties agreed on 11-month imprisonment that Emzar Kvitsiani had already served as Aleksandre Kobaidze said.

Kvitsiani declared disobedience to Saakashvili’s government and left country in 2006. On February 28, 2014, the wanted Kvitsiani returned to Georgia after the new government came in power in Georgia. He was arrested in the airport and Zugdidi district court sentenced him to 12-year-imprisonment.

The defense side appealed the judgment at the Appeal Court that was followed by the plea-agreement and finally by his release from the court room on January 28. Before that, security officers at the Kutaisi Appeal Court allowed only part of the attendants into the court room because there was limit of seats. Former defense minister Davit Tevzadze was among those who stayed out but unlike others he was later allowed to attend the process. There was incident between Kitsviani’s other supporters and security officers. However, when the convicted person was released from the court room, supporters calmed down.

“It is an agreement on the punishment and not on the accusation. Of course, we do not accept the accusation. Emzar Kvitsiani does not plead guilty,” the lawyer Aleksandre Kobaidze said.
