Fraud Victim Pensioner Asks for Help

“I am a pensioner and socially indigent. Every day I am afraid that we will be evicted and end up ინ streets. I do not know where to spend my old years. I live in unbearable conditions with my daughter and two small grandchildren,”- said Zhuzhuna Jobadze. 

11 years ago, because of heavy economic situation, Zhuzhuna Jobadze went abroad to work and support her family. She left her house in village Chumlaki of Gurjaani municipality to her neighbor Duansher Turiashvili. As she returned to Georgia, the neighbor refused to give the house back. Also, according to Jobadze, Duansher Turiashvili cut down her apple orchard and instead planted a peach orchard. After receiving refusal on transferring an ownership of the apartment, Jobadze requested financial compensation for peach orchard. Audit stated the value of the peach orchard in amount of 10 000 lari. However, based on the Gurjaani Court decision on December 25, 2013, Zhuzhuna Jobadze was ordered to pay 5000 lari. 

Zhuzhuna Jobadze addressed Human Rights Center office in Kakheti for help.
“I received this house under the will of my grandmother. I proved with documents that house was mine and the court imposed me to pay 5000 lari, because the ownership of peach orchard was being transferred to me,”- said Zhuzhuna Jobadze.

Zhuzhuna Jobadze’s neighbor Zaur Kartvelishvili lent her 5000 lari to pay, and requested to return this money in one week. According to Jobadze, because of the difficult economic condition, she was not able to pay the debt back before the set deadline. As a result, the neighbor appealed to the court and requested to register the house on his name. 

Apartment mortgage became an additional problem for Jobadze. As she says, to solve the financial problems, her son in law Giorgi Maisuradze proposed to help in exchange of mortgage, by which he would cover the bank loan  and withdraw new loan to pay Zhuzhuna Jobadze’s debt. 
“My son in law really gets the loan from Bank of Georgia, but lost it in gambling. After all this, in the middle of winter, he expelled my daughter Ia Dzindzibadze with her two children (10 and 7 years old) from house and I sheltered them in my mortgaged house,” – said Zhuzhuna Jobadze.
Jobadze should have been evicted from the house on April 17. According to her, despite the fact that the date of eviction has been delayed, she is in danger to become homeless. 
Zhuzhuna Jobadze addressed to the Ministry of Internal Affairs and Ministry of Justice for help, but in vain. Telavi District Prosecutor’s Office and law enforcement bodies also refused to help her. 
According to her, after this story, the mortgagee contacted her son in law, Giorgi Maisuradze and with his consent, the mortgagee EterI Kitesovy bought the house of Jujuna Jobadze by auction. 
‘The date of my eviction was April 17, which was postponed, but we are still under threat of eviction. Every day we are living in the fear. I am living in unbearable conditions with my daughter and two small grandchildren. We lost our house and we have no idea where to go,”- the victim told humanrights.ge

As a lawyer Lia Khuroshvili from Human Rights Center’s Kakheti office said Ia Dzindzibadze addressed her for help. 
According to her, Ia Dzindzibadze was victim of physical and economic violence from her husband for years. Zhuzhuna Jobadze financially supported the family for years. However, the son in law used to lose money in gambling and put the family in difficult conditions. Nor physical violence was strange for them. 
“Because of the argument about the mortgage, Giorgi Maisuradze set his wife’s clothes on fire and burnt them, which is a crime, but Giorgi Maisuradze was not punished. In the contrary, when a relative of Ia Dzindzibadze tried to solve the problem, Maisuradze provoked the relative and his two friends and as a result they spent 3 years in a prison. After this, nobody dares to help this family. We helped Ia Dzindzibadze to prepare a claim to get alimony, but the father never took care of his children. Thus, Ia Dzindzibadze and her mother Zhuzhuna Jobadze are victims of violence and fraud. However, despite the complaint submitted by Jobadze, the police claims the case should be studied under the civil law that is wrong,” Lia Khuroshvili said. 

Zhuzhuna Jobadze urges relevant authorities to show interest in her difficult social and economic problems and help them.
