The Ministry of Corrections to pay 20 000 GEL as compensation to the torture victim

October 18, 2016

Human Rights Center appealed the Court and requested financial compensation for the former convict Tamaz R, who was granted status of torture victim by prison personnel.

On October 7, the Ministry of Corrections took obligation to pay 20 000 GEL as compensation for moral and material damage to Tamaz R no later than 15 working days after the enforced court judgment is accepted for moral and material damage in the penitentiary establishment.

The convicted Tamaz R was victim of inhuman treatment and torture in the penitentiary establishment for years that significantly damaged his health conditions. He spent 12 years in prison.

On May 5, Besik Bugianishvili, the judge at the Criminal Law Collegium of the Tbilisi City Court, satisfied the appeal of Human Rights Center to postpone imprisonment term of Tamaz R. based on the article 283 of the Criminal Code of Georgia, which implies postpone of the prison term due to grave health condition of the convicted. Tamaz R. was released from the courtroom.

Human Rights Center welcomes the decision of the Ministry of Corrections. The state fulfilled its positive obligation and took important steps towards rehabilitation of the torture victim.

At the same time, Human Rights Center calls on the Ministry, to generalize this approach towards other victims too, who are waiting for the compensation and rehabilitation from the government for years, which falls under the responsibilities of the Ministry of Corrections, regardless the period when the crime was committed.
