Successfully litigated cases by Human Rights Center (November, 2017 – February, 2018)

Strasbourg Court Ordered the State of Georgia to Pay Compensation of 3 000 Euro

The State admitted the violation of the Article 3 (effective investigation into torture cases) of the European Convention on Human Rights with regard to D.Ch in front of the European Court of Human Rights and took up responsibility to pay 3 000 EURO to D.Ch as a compensation. With the legal aid of Human Rights Center, based on the ECtHR ruling, the State of Georgia is ordered to re-investigate the facts of ill-treatment of D.Ch in the penitentiary establishment # 8. The state unilaterally admitted the violation (Unilateral Declaration). 

With legal aid of HRC G.O was acquitted in the so-called “false denunciation” case 

With legal advocacy of Human Rights Center, the Tbilisi City Court acquitted the convicted G. O. in the so-called false denunciation case.

Initially Giorgi Okropiridze was accused of the murder into a resonant criminal case. After the court investigated his case, several days before the pre-trial imprisonment term was due to expire, the prosecutor’s office issued a completely new charge on Okropiridze and accused him of false denunciation and false testimony and sentenced him to a new pre-trial imprisonment. This particular decision of the prosecutor’s office raised a doubt that the new charge was issued to prolong his pre-trial imprisonment.

Tbilisi City Court held 70 hearings and were interrogated up to 200 witnesses into the so-called false denunciation case.

On November 10, the Tbilisi City Court acquitted convicted Giorgi Okropiridze in the charge on false denunciation and false testimony.

MIA is ordered to pay 5 000 GEL to Zh. G as compensation for moral damage

With the December 7 judgment, the Tbilisi City Court ordered the Ministry of Internal Affairs of Georgia to pay GEL 5 000 to Zh.G as a reimbursement for moral damage.

Human Rights Center defended the interests of the citizen injured during the dispersal of May 26, 2011 protest demonstration in front of the court. On July 23, 2013 the Chief Prosecutor’s Office of Georgia found J.G victim because of the damage he received as a result of used physical force, special means and disproportionate power against demonstrators during the dispersal of the May 26, 2011 protest demonstration. 

MIA to Pay 5 000 GEL to M.G as compensation for moral damage

On February 1, 2018 the Tbilisi City Court ordered the MIA to pay 5 000 GEL to M.G as a compensation for moral damage. Human Rights Center defended legal interests of M.G in front of the Court. On July 22, 2013 the Chief Prosecutor’s Office of Georgia found M.G victim because of the damage she received as a result of used physical force, special means and disproportionate power against demonstrators during the dispersal of the May 26, 2011 protest demonstration. 

Director of the medical clinic Lancet sentenced to 6-year imprisonment

Based on the appeal of Human Rights Center, the Chief Prosecutor’s Office of Georgia started investigation into alleged criminal offence committed in the medical clinic Lancet. Based on the judgment of the Tbilisi City Court, On May 24, the Chief Prosecutor’s Office of Georgia arrested the director of the medical clinic Lancet Farman Jeyranli for the extorting particularly large amount of money from the patients and for the creation of life-dangerous environment in the medical clinic. On February 8, 2018 the Tbilisi City Court found Jeyranli guilty in the imposed charge and sentenced him to six-year imprisonment.

In February 2018 based on the HRC application, prosecutor’s office prosecuted surgeon Mirjalal Kazim, who was invited to medical clinic Lancet by the former director of the clinic from Azerbaijan, for the extorting particularly large amount of money from the patients and for the creation of life-dangerous environment in the medical clinic. 

Human Rights Center provides the family members of G.Ch and K.K, with legal aid, who were deceased after the liver transplantation operations in the medical clinic Lancet.  

Socially indigent single mother was freed from 10 000 GEL fine

In January 2018, the Tbilisi Appeal Court satisfied the appeal claim of Human Rights Center and ordered the Tbilisi City Hall to re-consider the case of D.Ch. Also, by annulling the acts issued by the Tbilisi City Hall and the City Hall supervision service D.Ch was freed from the payment of 10 000 GEL fine. Based on the court judgment, the City Hall will not dismantle the house of D.Ch. 

Human Rights Center provides the socially indigent, homeless single mother D.Ch with free legal aid and assists her to get shelter. D.Ch several times petitioned different institutions but could not get assistance from them. Consequently, D.Ch constructed one room shelter in the plot which she owned for the 20 years. 

For the construction of the shelter, the Tbilisi City Hall supervision unit fined D.Ch with 10 000 GEL and ordered to dismantle it. 

With the legal aid of the Tbilisi and regional offices of Human Rights Center, 4 beneficiaries finished their court disputes with agreement, the local courts appointed the supporter for two beneficiaries of the HRC, 4 beneficiaries managed to determine the facts of legal importance and the Tbilisi Appeal Court upheld the decision of the first instance court and freed I.K from the payment of GEL 10 000 fine imposed on him by the Tbilisi City Hall.
