Joseph Kay Lost Several Trials about Badri Patarkatsishvili’s Property

London Arbitrage Court confirmed falsification of Badri Patarkatsishvili’s signatures on the documents provided by Joseph Kay. Lasha Birkaia, attorney of the Patarkatsishvili’s family stated about it at the press-conference in the hotel Tbilisi Marriot today.

According to Birkaia, attorneys of the Patarkatsishvili’s family handed new claiming to the Supreme Court of Georgia against Joseph Kay. Birkaia added that the claiming make the conclusion of Gas R. Lesnevich, leading expert of international law, complete. According to the conclusion, the signatures of Badri Patarkatsishvili on the documents provided by Joseph Kay were fraud.

“The aim of the Bureau of London Forensic Expertise was to examine 11 copies of Patarkatishvili’s will which were signed by him during one day. It must be noted, that four out of 11 signatures are equal; that means they were copied. Four more copies of the will confirmed by the notary in advance were also examined which did not have Badri Patarkatsishvili’s signature,” said Birkaia.

The attorney added that more than 70 documents were examined which declared Joseph Kay to be the executor of Badri Patarkatsishvili’s will; in several documents Emanuel Zeltser was announced to be the executor of the will.

“We underscore that according to the expertise conclusion, every document was drawn up after the death of Badri Patarkatsishvili. Considering various circumstances, London Court sequestered the personal accounts of Joseph Kay. Besides that, the court ordered to search the London office of Joseph Kay and withdraw some documents which will be examined by the London Court,” said Birkaia.

Before the discussion ends, London Court refused to allow Joseph Kay to manage the property of Patarkatsishvili.

“We would like to remind you that Liechtenstein Court has already exposed failure of Kay to misappropriate the property of Patarkatsishvili’s family. Gibraltar Court deprived Kay from the right to control his assets. If Georgian court does not take the proofs into consideration, we will appeal to Strasbourg Court,” Birkaia stated.

Lasha Birkaia stated at the press-conference that the court will interrogate vice-president of Businessmen’s Association of Georgia Giorgi Isakadze to estimate the circumstances of registering the TV-Company “Imedi” on Joseph Kay.

He added that former owner of the 70 % of the JMG Consulting Group Gogi Jaoshvili has already appealed to the court in Georgia; the group owned TV-Company “Imedi” too.

“Jaoshvili claims the agreement between him and Joseph Kay were signed under force. Jaoshvili petitioned to the court to interrogate Giorgi Isakadze and Notary Meri Gubashvili who approved the agreement. Jaoshvili states that Isakadze attended the process of signing the agreement and he knows how the document on assigning the TV-Company “Imedi” on Kay was signed,” said Birkaia.

Jaoshvili added that the court satisfied his petition and Isakadze and Gubashvili were invited to the trial. The trial will be scheduled in near future.

According to Birkaia, London Arbitrage Court also discusses the argument between Patarkatsishvili’s descendants and Republic of Georgia about TV-Company “Imedi”.

Nana and Mzia Patarkatsishvilis as well as spokesperson of the family Nona Kandiashvili attended the press-conference.
