The Criminal Procedural Code Will be Changed

The Georgian Ministry of Justice is currently working on a new project concerning the Criminal Procedural Code; the Ministry itself has introduced one of its chapters –Procedural Enforcement Measures – to the lawyers for discussion.
The new government found some faults with the Code, which was worked out by the commission established in the Supreme Court three years ago and began to prepare the new one.
According to the new project pre-trial detention of a person accused of a criminal action shall be finished in 100 days. Also, court detention must not exceed 6 months (at present the term of pre-trial detention is 9 months whilst court detention is even more than 2 years); the defendant and his/her attorney have the possibility to appeal the sanction of detention at any time, if they have grounds for that.
There are many other innovations in the project regarding the detention of a person, which will be discussed in the Ministry of Justice.
According to Giorgi Papuashvili, the Minister of Justice, the new project of the Criminal Procedural Code will be brought to the public’s attention in a detailed way for discussion and their judgment as the project should be introduced to the parliament in an accomplished form.
