Change in Executive Department


Tbilisi.23.11.04.Media News. The Ministry of Justice prepared a package of legislation amendments. The bill to amend the “Georgian Law on Executive Proceedings” considers general improvements to the applicable legislation and a transformation of the executive department into a legal body subject to public law. Such changes to the “Georgian Law on Executive Proceedings” are expected to give more independence to the service.
Although the executive department will remain a subject of the Ministry of Justice, it will dispose of an independent budget. This model of the executive department has been elaborated on the experiences of other European states.


The package includes a bill for amendments to the law on the “Activity of Commercial Banks”.  It proposes a right for the executive to demand bank information on requisites of those accounts of legal and natural bodies,which are subject to forcible execution. The current legislation does not give such rights to the executive, hence complicating the execution of court decisions.


The government has already forwarded the proposal to the parliament for discussion.
