Gurjaani District Prosecutor's Office Ceased Preliminary Investigation on Journalist's Beating

Tbilisi. 19.12.06. Media News. Ramaz Samkharadze, Director of the Broadcasting Company Hereti, received a notification from Giorgi Kokiashvili, a prosecutor of the Gurjaani District, about ceasing the preliminary investigation. The information was spread by radio Hereti.

The case deals with the beating of Ramaz Samkharadze on October 9. The incident was a result of the item broadcast in informational-analytical program Mteli Kvira (the whole week) on radio Hereti.

Davit Kapanadze, former MP had opposed Ramaz Samkharadze and threatened him by closing down his Radio Company and also by physical liquidation.

Preliminary investigation proved that Kapanadze's behavior did not turn into hooliganism and public disorder.

Nato Chikhradze, a lawyer of Ramaz Samkharadze declared that the prosecutor had violated the law by giving wrong qualification to Kapanadze's behavior: "Under the Georgian Criminal Code, Article 144, Prima Article III, insulting, degrading and inhuman treatment of a person, what results into his/her physical and physic torture, is a disposition. This Article really envisaged Kapanadze's behavior. "

According to the Radio Hereti, Gurjaani District Prosecutor Giorgi kokiashvili discussed the case and having no suit of the victim, ceased preliminary investigation. However, Ramaz Samkharadze appealed the police on the same day, October 9. The letter was registered at Lagodekhi Police Chancellery and it was given the number c-10. The conclusion stated that the police had received the notification from the Lagodekhi District Hospital.

The conclusion of the Prosecutor states that, "On October 9, 2006 Lagodekhi District Department of the Georgian Interior Ministry launched the preliminary investigation on the criminal case on the basis of notification received from the Lagodekhi District Hospital. The case was launched about Ramaz Samkharadze's physical assault under the Georgian Criminal Code, Article 118, section I."

According to the last paragraph of the two-page conclusion "the preliminary investigation is ceased against Davit Kapanadze because of the lack of victim's suit," says the radio Hereti. At present,, Ramaz Samkharadze is going to appeal the Lagodekhi District Court.
