Public Defender’s Position Regarding the Criminal Liability of Juveniles

The Public Defender’s Office has started working on the project framework, “Criminal Liability of Juveniles” together with foreign experts.

The Public Defender considers that the principal aim of the juvenile’s liability should be the rehabilitation of the law-offenders and not their punishment. In this field Georgia should take example from the experience and practice of the countries within the European Union.

Consequently, the lowering of the age for juvenile liability can be acceptable if the criminal responsibility is envisaged by special law and not under the Criminal Code. The special law should focus on tutorial and disciplinary activities that will envisage the means of criminal liability in extraordinary situations. Imprisonment can also be viewed as the most severe mean of punishment.

The Public Defender’s Office will start working on the project framework in the nearest future.
