Strasbourg Court Ordered the Government of Georgia to Pay Compensation of 3 000 Euro

November 8, 2017

European Court of Human Rights ordered the Government of Georgia to pay 3 000 EURO to the former prisoner, who was victim of torture.

With legal aid of Human Rights Center, citizen of Georgia D.Ch appealed the European Court of Human Rights in 2014 and claimed that he was victim of torture and inhuman treatment in the penitentiary establishment # 8 before 2012.

As a result of beating and inadequate medical treatment D.Ch had his eyesight significantly worsened. Consequently he cannot continue his professional activities as a painter.

Human Rights Center sent relevance evidence on the ill-treatment to the Strasbourg Court. The application claimed violation of the Article 3 (prohibition of torture) and Article 13 (ineffective domestic remedies) of the European Convention on Human Rights.

Before the ECtHR passed verdict, the Government of Georgia made unilateral declaration and admitted to the violation of the Articles 3 and 14 and the Court shared their admission.

Finally, the State is ordered to pay 3 000 EURO to D.Ch and to resume investigation into the torture case.

Head of the legal aid service at Human Rights Center Tamar Avaliani represented D.Ch in front of the European Court of Human Rights.
