Tbilisi City Court Is Dragging Out Consideration of the Case of the Torture Victim Prisoner

The Administrative Panel of the Tbilisi City Court is processing the claim of G.J, victim of torture from the side of the prison personnel, on the reimbursement of his material and moral damage. The Ministry of Corrections is the defendant side in the process. 

The first preparatory session into G.J’s case was held on February 2, 2016 and since then the torture victim has been unsuccessfully waiting for the next preparatory hearing of his appeal.

HRC lawyer several times addressed the administration members of the court to react to the prolonged court proceedings into this particular case and to replace the judge into G.J’s case but none of our petitions were responded. 

On April 10, 2017, Human Rights Center filed a complaint to the High Council of Justice with regard to groundlessly dragged out proceedings into G.J’s case and unexecuted or poorly executed professional duties by the judge and requested the HCoJ to impose disciplinary liability over the judge though the Council did not react to the complaint either. 

Human Rights Center represents several beneficiaries in similar cases in front of the court and specifically the judge in charge of G.J’s case has already finalized consideration of those cases. It is noteworthy that the other cases were submitted to the court later than the appeal of G.J. 

Human Rights Center is alarmed with the unreasonable delay into the substantial discussion of the appeal of the torture victim at the Tbilisi City Court. 

Human Rights Center calls on the Tbilisi City Court to review the appeal of the torture victim prisoner within reasonable timeframe and in due respect of effective and fair justice. 

On August 7, 2013, G.J received status of the victim of systemic torture from the side of the prison personnel. In accordance to the court verdict, which was already enforced, the concrete prison officers were convicted for the torture of G.J.
