Strasbourg Court Received the Application of Human Rights Center

The European Court of Human Rights received and assigned a case number to the application prepared by the Human Rights Center. The Human Rights Center applied to the ECtHR regarding the violations of Article 6.3 and Article 13 of the Convention. The principle was violated vis-a-vis the applicant according to which with a purpose of safety of a person, the person shall be notified about the reasons and status he/she is summoned to the investigation bodies in order he/she to be able to consider the legal consequences of non-appearance. 

The applicant was actually deprived of the objective possibility to receive the assistance and advice from a lawyer within 48 hours from the detention as proved by the fact he has not voluntarily left the investigation body and interrogation room. He was in the investigation body under the monitoring of the officers of the investigation body.

Moreover, a criminal case is ongoing in the Office of the Prosecutor General on the fact of exerting an influence over the applicant with the purpose of detention and obtaining then a testimony favorable to the investigation; irrespective of the number of statements and complaints on the above case, the applicant was never recognized as a victim that would give him the possibility to make himself familiar with the case files, and by this, his right to a fair trial was violated.
