14 Homeless Families VS Chairperson of Community

Residents of Shartava Street # 75 in Tbilisi urge for help. The two-storied house, which belonged to 14 families, was deconstructed 3 years ago. The families rent flats before the new building is built. However, the construction has been prolonged endlessly.

On January 23, 2007 the owners signed agreement on joint cooperation which aimed to construct residential building in Shartava Street # 75 and to receive flats in the new residential building. According to the agreement the building was to be built completely with all necessary communications, windows and doors in the outside façade and common spaces. In 2007, the individual agreement was signed with every owner; however, property owners doubt the agreements were one of the tools to deceive them.

Chairman of the community of the “Shartava Street # 75-2007” Badri Gaprindashvili does not keep his promise to property owners. “According to the agreement, he had to pay 200 USD for our flat rents but he has not paid anything for 3 years already. We have taken loans to pay the rents. He gives false promises each time – “borrow money and I will pay them back.” He evicted us out, destroyed our house and left us homeless; a person cannot be more insulted! He has not replied to our phone calls lately. We visited him at home and they did not open the door,” said one of the property owners, Dali Kantidze.

Chairman of the community Badri Gaprindashvili states accusations against him are groundless. “The conclusion of the state expertise states that the two-storied house was damaged by the filtration of the Lisi Lake and the walls were damaged. Part of the property owners did not live in the building. I did not destroy anything. The territory was cleaned based on joint decision. These people should receive flats in new residential building. The only crime I have committed is delay in paying rent for their current accommodations. It is not my fault either. We cannot attract investments because of some problems. However, we promise all problems will be resolved by the end of June.”

According to the agreement between property owners and the Community, the new residential building was to be finished by the end of 2009. However, nothing has been built in the area; only basement was constructed.

Badri Gaprindashvili cannot say exact date when the construction will be renewed. It increases the doubt of property owners that they will have to stay homeless for a long time.

“We had to receive flats at the end of 2009 but you see they have built only basement of the building. If this person remains the chairman of the community, we do not know how long we will have to wait for our flats. He negotiates with the builders and investors without agreeing the issue with us. He offers such high prices to the investors that they immediately refuse to start construction. He compels us to appeal against him and return our property back,” said the property owners.

The board members of the community “Shartava Street # 75-2007” appealed to the Vake-Saburtalo district office of the Tbilisi Police Main Department several times. The official letter of the police department states that the agreement between the parties is topic of civil argument and the suitor can appeal to Tbilisi City Court. The property owners have not appealed to the court yet but they intend to use this chance too to gain their properties back.
