Removing “Grave Violation of Law” from the List of Types of Disciplinary Violations Found Inadmissible by GYLA

Georgian Young Lawyers Association (GYLA) finds it inadmissible to remove the “grave violation of law” from the list of types of disciplinary violations of judges.

The representative of GYLA Sopo Verdzeuli stated the following on February 10th at the Human Rights and Civil Integration Committee of the Parliament while discussing the draft amendment on changes to the Law on Common Courts of Georgia.

According to her, if the authors of the draft law think that this provision is not comprehensive and is just evaluative, it would be better if the talks started about its development and not about its entire abolishment.

As for removing the “disciplinary violation of labor” from the list of types of disciplinary violations, GYLA thinks that this decision is correct.

As Verdzeuli noted this provision created threat of its unduly use and it is advisable that they changed it.

The provision of Law on Disciplinary Responsibilities and Disciplinary Proceedings of Judges of Common Courts of Georgia which imposed disciplinary responsibility on judges for grave violation of law is going to be abolished. According to the same provision, violating the imperative norms of Georgian Constitution, international agreements and legislation of Georgia that caused substantial damage to the legal rights and interests of the third parties or public was considered a grave violation of law.
